Support Justice and Accountability for Crimes Committed During Israel's Attack on Gaza
Dear Friends:
On October 23, Rep. Ileana Ros-Lehtinen (R-FL) introduced HR 867, which calls on the President and the Secretary of State to "unequivocally oppose any endorsement or further consideration of the Report of the United Nations Fact Finding Mission on the Gaza Conflict [commonly known as the Goldstone Report] in international fora." The report, authored by South African Justice Richard Goldstone, found evidence that Israel and Hamas committed war crimes during Israel's December 2008-January 2009 attack on the Gaza Strip. The report urges independent investigations by Israel and Hamas into such evidence. Should the parties fail to conduct such investigations, the report calls upon the U.N. General Assembly, the U.N. Security Council and the International Criminal Court to investigate and hold the guilty parties accountable for crimes committed.
HR 867: (a) contains numerous factual errors, as Justice Goldstone himself has identified in a letter to the House Committee on Foreign Affairs; (b) undermines the United States' commitment to human rights in the Middle East and around the world; and (c) further damages the image of the United States (particularly Congress) among citizens of majority-Arab and Muslim countries, harming President Obama's efforts to improve relations between such citizens and the United States.
As of November 2, the bill had 114 co-sponsors. A vote is expected to take place tomorrow, Tuesday, November 3.
AAPER strongly opposes HR 867 and supports the Goldstone Report's call for accountability and basic justice for the victims of crimes committed during Israel's attack on Gaza. The United States should staunchly protect human rights and support justice for the victims of human rights violations, not oppose calls to ensure that human rights are protected and justice done. AAPER urges you to contact your representative and ask that he or she vote No or Present on HR 867.

UNITED NATIONS, Nov 2 (Reuters)
- Arab U.N. delegates circulated a draft resolution on Monday that would require Secretary-General Ban Ki-moon to bring a U.N. report alleging war crimes in the Gaza Strip before the Security Council.
A special meeting of the 192-nation assembly on Wednesday will debate the U.N. report on the December-January war in the Gaza Strip and vote on the draft resolution.
That report accused Israel and Palestinian Hamas militants of war crimes and was prepared by a U.N. fact-finding commission led by South African jurist Richard Goldstone.
The Arab draft resolution, obtained by Reuters, says the assembly "requests the Secretary-General to transmit the report ... to the Security Council." It also urges Israel and the Palestinians to comply with the report's recommendations for launching investigations into allegations of war crimes.
The draft also tells Ban to report back to the assembly within three months on implementation of the resolution.
Arab and Western diplomats told Reuters there was little doubt a majority of the General Assembly would vote in favor of the Arab draft. But negotiations were underway as Arab delegates sought to persuade Western powers to back the text.
Western diplomats said the United States would most likely vote against the resolution. Unless it is revised, they said, most European delegations would join Washington and reject it.
Resolutions of the General Assembly, unlike those of the Security Council, are nonbinding. But U.N. diplomats say such a resolution would intensify pressure on Israel to launch a full investigation into the actions of its army during the war.
The Goldstone report lambasted both sides in the war, which killed up to 1,387 Palestinians and 13 Israelis, but was harsher toward Israel. It gave Israel and Palestinian Hamas militants six months to mount credible investigations or face possible prosecution in The Hague.
WESTERN DIPLOMATS REJECT ARAB DRAFT
Both Israel and Hamas denied committing any war crimes. Israel has criticized the report as unbalanced and says the 47-nation Geneva-based U.N. Human Rights Council, which commissioned the report, is biased against the Jewish state.
An Israeli official in New York condemned both the report and the assembly's discussion of it. "At a time when we are debating restarting peace talks, this is not helpful to anyone," said the official, who asked not to be identified.
Diplomats said the five veto-wielding permanent council members -- United States, Britain, France, Russia and China -- all agreed that there was no point in bringing the issue to the the Security Council, which meant it was unlikely the 15-nation panel would do anything with the Goldstone report.
The Arab draft resolution does not explicitly endorse a Human Rights Council resolution from last month that censured Israel for its actions in the Gaza war without referring to any wrongdoing by Hamas. The United States voted against that resolution while France and Britain abstained from the vote.
But it does endorse an HRC report that included the resolution. Sudan's U.N. Ambassador Abdalmahmoud Abdalhaleem said it amounted to a full endorsement of the HRC resolution.
"It endorses the Human Rights Council resolution, that is the point," he told Reuters. " And it exposes the double standards that some permanent Security Council members have towards the occupying power (Israel) in Palestine."
Several Western diplomats told Reuters the Arab draft was "unacceptable" because of its endorsement of the HRC actions and for requesting Security Council intervention.
Abdalhaleem said the Arabs had rejected an earlier European draft that said the General Assembly would merely "take note" of the Goldstone report and pass the issue back to the HRC.

As well, anyone who heard NetsenYahoo, in a speech by him to the U.N. General Assembly, demean, attempt to dominate, abuse all the world, with his scathing attack of Mr. Goldstone's fair investigation results of both Israel and Hamas, Mr. Goldstone himself ( a person of Jewish decent and a self-proclaimed Zionist ), The U.N.'s Human Rights Council, and the U.N. as an organization, and each individual in it, would, not only be appalled, they would be absolutely certain that the reasons why the Israeli Gov't refused to give meaningful cooperation to his investigation is that the Israeli Gov't was absolutely clear that the level of war crime and atrocity against humanity committed by their Gov't and military were astronomically more than Hamas, with all things considered; and it was, and is self-evident. A line of his sums up their actual position, as it is, was, and, probably, always will be, contrary to their historically stated, ad nauseum, policy of a desired "two-state solution" and “peace“, and I quote, "...either you're on the terrorist's side, or democracy's (ours), and everyone must choice..."; which is exactly what emperor georgie said before, during, and after he ordered the USA Gov't to falsify and fabricate intelligence, reports, assessments of Mr. Hussein, the Iraqi Gov't, their having weapons of mass destruction ( which, even though the USA sold him such weapons for decades, he got rid of, as part of the first Iraqi war's ending armistice agreement ), their scientific and militaries capacities, etc., in his run-up to dictating the USA Gov‘ts unnecessary, and “illegal“, according to Kofi Annan, the former Secretary General of the U.N., war with Iraq, which continues to this day. So, for the Israeli Gov't, it's divide and conquer the world, to gain their Machiavellian end, the destruction of Palestine, first, Iran, second, probably, and who knows how many other Middle Eastern, and/or Islamic countries, third, and on; while constantly asserting their permanent "victim-hood" and supposed unwavering desires for "peace", etc.. Adding continuous insult to injury, of the world, by the Israeli Gov't, wouldn't come close to describing the imperial false-ego of their renegade nation's Gov't's words and actions; when will the reality in front of the world's nose be acted upon, and the U.N. hold to its solemn duty, by condemning Israel's omissions, absentia, and actions- their determined program of refusing to allow peace between them and Palestine? It has fueled a global movement of reaction that could easily dictate the extinction of humanity and large mammals, alone, itself, if you let it, so, don't you let it.
